Distance Sales Agreement

This Distance Sales Agreement (“Agreement”) is established between the Seller, whose information is provided below, and the Buyer, who places an order electronically, in accordance with the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

Buyer

The name, surname, address, phone, and email information declared during the order placement shall be taken as the basis.


2. Subject of the Agreement

The subject of this Agreement is the determination of the rights and obligations of the parties regarding the sale and delivery of the product ordered by the Buyer electronically via the Seller’s website, the characteristics and sales price of which are specified.


3. Product Information

The type, model, size, color, sales price, payment method, and delivery information of the products are as specified on the order summary screen and the invoice.


4. Delivery and Delivery Time

  • Products are prepared and handed over to the courier after the order is confirmed.
  • The dispatch period for ready-made products is 7 business days. For orders requiring special adjustments or revisions, this period may extend up to 14 business days.
  • Domestic deliveries (within Turkey) are generally carried out within 2–3 business days after dispatch.
  • For international shipments, the delivery time may vary depending on the destination country.

Delivery will be made to the address provided by the Buyer during the order process.


5. Payment

The Buyer agrees to pay the order amount using the methods specified on the payment screen. Orders will not be processed until the payment is successfully completed.


6. Right of Withdrawal and Return Conditions

In accordance with Article 15 of the Distance Contracts Regulation:

The Buyer acknowledges that there is no right of withdrawal for products produced according to personalized measurements, designs, models, or specific requests.

Since the products offered at LuminaDonna are made-to-order and personalized, returns and exchanges are not accepted.


7. Defective / Faulty Products

  • Products suspected of having a manufacturing defect must be reported to the Seller in writing within 7 days from the delivery date.
  • If a manufacturing defect is identified upon inspection, the product will be repaired or reproduced free of charge.
  • Returns or exchanges will not be processed for damages caused by the user.

8. Damage During Delivery

If any damage to the product or packaging is detected during delivery, it is mandatory to have the courier issue a Damage Assessment Report. Damage claims without such a report will not be accepted.


9. Force Majeure

In circumstances beyond the control of the parties, such as natural disasters, strikes, wars, epidemics, or decisions by official authorities, the provisions of the agreement may be suspended.


10. Protection of Personal Data

Personal data belonging to the Buyer is processed within the scope of the Law on the Protection of Personal Data (KVKK / GDPR) and shared with third parties only within the framework of legal requirements.


11. Dispute Resolution

For disputes arising from this Agreement, Consumer Arbitration Committees and Consumer Courts in the Buyer’s place of residence are authorized within the monetary limits declared by the relevant Ministry.


12. Enforcement

The Buyer declares that they have read and approved this Agreement electronically and accept all its provisions.

The Agreement enters into force upon the confirmation of the order.
